Title Nine Essay Example For Students
Title Nine Essay All through ages, people have played composed games and sports. For that equivalent measure of time, it has been imparted that men are quicker, more grounded, and downright better at sports. We additionally have come to understand that the more slow, more fragile, and not as great ladies compensate for physical quality with mental ability, to prevail on the playing fields and courts of the world. In any case, this idea has not found athletic executives, mentors, and trustees sheets the nation over. Womenââ¬â¢s sports is as yet not given the money related sponsorship, the training offices, the right preparing work force, and the help of the overall population for building winning projects; then again, losing menââ¬â¢s programs are given any and everything for unremarkable outcomes. Title IX was instated 25 years back, however the outcomes are difficult to see, on the off chance that they can be seen by any means. In states like Connecticut, where there are no pro athletics groups, state colleges are the expensive around. The University of Connecticut has two significant games, menââ¬â¢s and womenââ¬â¢s ball. We will compose a custom exposition on Title Nine explicitly for you for just $16.38 $13.9/page Request now Winning projects, that incorporate national titles, have everybody in the state talking. They are discussing two effective mentors, two fruitful groups, and one effective athletic office. As per the UConn Athletic website page, Jim Calhoun, mentor of the UConnââ¬â¢s Menââ¬â¢s Basketball crew, has a 304-120 (. 717) record and 1 national title in his 13 years as lead trainer. Geno Auriemma, mentor of the UConnââ¬â¢s Womenââ¬â¢s Basketball crew, has a record of 393-95 (. 805) and 2 national titles in the course of recent years. One would imagine that with status, a superior winning rate, and progressively national titles the womenââ¬â¢s mentor would be paid better. No doubt OK, this is America. Geno Auriemmaââ¬â¢s pay was about $ 250,000 for the year, while his male training partner made $ 875,000. (Walk 2000 issue of Connecticut Magazine) This training is entirely normal. Position or winning doesn't win more cash, since it is accepted that the menââ¬â¢s game is harder to mentor then the womenââ¬â¢s game. Ummâ⬠¦ am I missing something? A game is a game, regardless of who is playing it, or so I thought. As indicated by the Detroit Free Press mentors of womenââ¬â¢s groups, acquire 67 pennies to each dollar that a mentor of a menââ¬â¢s group wins. These were demonstrated not to be the main inconsistencies among menââ¬â¢s and womenââ¬â¢s program. The Detroit Free Press examination shows womenââ¬â¢s sports get 25 percent of the athletic spending plans, 27 percent of the enrolling dollars and 38 percent of the monetary guide. The normal Big 12 School spent a normal of 2. 2 million dollars on its menââ¬â¢s programs. The normal spent on womenââ¬â¢s programs was $ 922,097. Thatââ¬â¢s a distinction of around 1. 3 million dollars. These patterns proceed all through the nation. Athletic Directors rush to add womenââ¬â¢s projects to be agreeable with the law, however do little to help them once they are going. Womenââ¬â¢s programs are then placed into a unimaginable circumstance; they are not given the assets to get the best enlists, the best mentors, or the best hardware. They are then advised to win, and on the off chance that they don't they are at risk for losing their game. On the off chance that they happen to win, it is regularly overlooked or overlooked rapidly. As we move into the 21st century, we need to wake up as a country. Balance isn't just giving guys and females a similar number of competitors or sports, but instead help. This help ought to be money related, passionate, and physical. All competitors should gaze toward home games and see the President of the University, the Athletic Director, and graduated class at a game. In the ideal world, this would occur however this is this present reality. In reality, a great many people canââ¬â¢t disclose to you who won the national title in womenââ¬â¢s ball, however can reveal to you each washout in the previous 10 Super Bowls.

I think weve all observed that father and young man playing get outside for a considerable length of time when everybody realizes that young man simply needs to head inside and drink a decent glass of lemonade and possibly eat a treat. Pushy guardians are nothing unexpected in our way of life and Steven Zaillian investigates the possibility of pushy guardians in Searching for Bobby Fischer, Zaillian is the chief just as screenwriter making what I accept to be perhaps the best film of the nineties, it advances the topic of inner drive being the most significant factor of accomplishing an objective. In Searching for Bobbie Fischer Josh is driven by Bruce who is attempting to shape him into another Bobby Fischer, a previous title holder chess player. Josh in the end loses enthusiasm for chess and carries on with an ordinary life, while he chose to carry on with a typical life he additionally begins getting a charge out of chess once more. Josh begins playing chess at the recreation center with his companion Winnie and chooses to enter in another chess competition. The topic of Searching for Bobbie Fischer is that interior drive is the most significant factor to progress, this subject is exhibited all through the film. This topic begins when Joshs guardians acknowledge he is an amazingly decent chess player. Josh just delighted in the game and afterward he began not to like it when he was taken to such a large number of chess competitions. When Josh was playing in light of the fact that others needed him to play he lost concentration and lost the match. Joshs mother understood that Josh wasnt playing for himself any longer and put the chess competitions to an end. Sooner or later Josh understands that he needs to play chess for himself, gets went into the title and makes it to the last round. This is a case of the thereof inner drive being the most significant key to progress since when Josh doesnt have it he loses and when he has it he accomplishes a great deal. The method of this film likewise has a ton to do with the nature of the film and plays well with the topic. One thing they did to make the method truly stand apart is the lighting, the light of this film is one of a kind on the grounds that the movie producers chose to depict the chess sheets, in the room where he rehearses with his mentor the chess board is in a faintly lit room and has an intense tone about it causing it to appear to be an intense issue though in the recreation center the chess block is lit outside and the tone is brimming with life and glad. Another way they utilized method would be the tone with the various settings substituting from genuine to fun loving and changing the state of mind of the film to keep watchers intrigued. They additionally use Joshs mentor and companion as foils to one another giving them both two altogether different characters and alongside their characters two totally different chess procedures yet they despite everything depict Josh as being aware and a decent understudy to them two. As is apparent Searching for Bobby Fischer advances the subject that interior drive is the way to progress, Steven Zaillian shows this through the plot, topic, and the strategies utilized in this film and surrenders a nearby assessment to pushy guardians whose kids perhaps simply need to head inside and have a glass of lemonade.

Human Relations Essay Example for Free
Human Relations Essay Kid improvement alludes to an individualââ¬â¢s progress from birth to adulthood. There are a few changes that happen in an ordinary personââ¬â¢s life length physical, psychological and psychosocial (Fitch, 1999, p. 9). The three structure the spaces of youngster advancement. Physical improvement alludes to the progressions that happen in the individualââ¬â¢s body, for example, stature, weight, tangible and engine capacities, just as the hormonal changes (p. 9). Then again, psychological improvement insinuates the scholarly changes that happen as kids create (p. 9). As youngsters develop, they begin to create perspectives about themselves and their environmental factors. As they keep on scanning for their character, their psychosocial advancement likewise unfurls. There are various speculations that tackle youngster improvement. Stage speculations are hypotheses that focus on formative levels that are ââ¬Å"quantitatively differentâ⬠from different levels (p. 40). Quantitative, in this sense, implies that each formative level is a movement, an incorporation of past conduct and data (p. 40). Besides, the movement starting with one phase then onto the next is intermittent, demonstrating that it follows a fixed arrangement (pp. 40-41). Scholars who buy in the stage hypotheses of youngster improvement accept that all stages are all inclusive (p. 41). There are three significant scholars in kid advancement: Sigmund Freud, Erik Erikson and Jean Piaget. Sigmund Freud is considered the ââ¬Å"father of psychoanalysisâ⬠(Thornton, 2006). Therapy is a procedure created by Freud that is utilized to reveal the oblivious (Morris and Maisto, 2002, p. 15). A clinical specialist by calling, Freud was especially intrigued by the focal sensory system (p. 14). In his life of work, he found that most illnesses are mental in nature, as opposed to physiological. Therefore, he arrived at the resolution that human conduct is driven by the oblivious senses (p. 446). He accepted that the oblivious senses are crucial in an individualââ¬â¢s endurance. In addition, he emphasizd the significance of sexual senses as the most significant component in character advancement. Character, as per Freud, is created around three structures: the id, the self image, and the superego (Fitch, 1999, p. 41). The id is guided by the delight standards, self image, the truth guideline, and superego, the ethical rule (p. 41). These structures are urgent in Freudââ¬â¢s hypothesis of psychosexual turn of events, or his keen on kid advancement. There are five phases in Freudââ¬â¢s Psychosexual Theory, each stage including a few degrees of sexual vitality. As indicated by Freud, as kids experience each stage, their character is being created. Nonetheless, when a youngster experiences horrible encounters, the sexual vitality that ought to have been at that specific stage might be influenced, bringing about what Freud named as obsession (Larsen and Buss, 2005, p. 47). Obsession may later prompt adolescence and certain character characteristics. In the oral stage (birth to year and a half), the infantââ¬Ës focal point of delight is the mouth (Morris and Maisto, 2002, p. 448). During this stage, the infantââ¬â¢s id is prevailing, particularly in light of the fact that the newborn child still can't seem to separate oneself and nature (Larsen and Buss, 2005, p. 47). The newborn child acquires oral joy by sucking, biting and gnawing (Morris and, p. 448). Babies who get a lot of joy will develop into idealistic grown-ups; the individuals who get little will transform into unfriendly grown-ups (p. 448). During the butt-centric stage (year and a half to 3 ? ears), the childââ¬â¢s essential wellspring of sexual joy is the rear-end (Morris and Maisto, 2002, p. 448). In this stage, the childââ¬â¢s personality is beginning to separate from his/her id and the youngster begins to build up independence (Larsen and Buss, 2005, p. 47). The kid begins to learn disposal and he/she gets sexual joy from holding in and removing excrement (p. 448). This is additionally when can preparing starts. Severe latrine preparing may bring about youngsters pitching fits, which as indicated by Freud will lead them into reckless grown-ups (p. 448). The third stage-phallic stage, happens after the youngster arrives at three years old (Morris and Maisto, 2002, p. 448). In this stage, the two young men and young ladies look for delight from controlling their private parts (p. 448). Curiously, kids become explicitly pulled in to other gender parent (Larsen and Buss, 2005, p. 48). Freud calls this the Oedipus and Electra complex (p. 448). The previous alludes to the Greek fanciful character that slaughters his dad and weds his mom (p. 448). The last alludes to the to some degree possessive love that young ladies show toward their dad while feeling envious of their moms (p. 48). The childââ¬â¢s superego is additionally beginning to take control, as the kid begins to pay heed to his/her parentsââ¬â¢ values just as that of the general public. Obsession in this stage may prompt vanity and self love in later life. Or on the other hand it might prompt the inverse, wherein the individual gets pulled back, modest and has low confidence (p. 448). At the point when the kid arrives at 6 up until he/she arrives at pubescence, the youngster goes into an inactivity stage. During this period, sexual advancement is at a halt (Larsen and Buss, 2002, p. 51). The youngster loses enthusiasm for sexual conduct and rather starts concentrating on learning aptitudes that will support him/her become capable residents in the general public (p. 510. ). At adolescence, the youngster arrives at the genital stage. It is during this stage wherein sexual pressure develops. It is a time of sexual development. The genital stage is the last stage in sexual turn of events and it is in this phase where teenagers and grown-ups can complete unfilled wants from earliest stages and youth (Morris and Maisto, 2002, p. 448). It is when full grown sexual connections are built up.

The Theory And Practice Of Risk Management Finance Essay - Free Essay Example
Since the 1970s, world business transactions have experienced and contributed to diverse sources of financial uncertainty or risk (see, Dowd, 2005; Holton, 2003; Jorion, 2006; Tardivo, 2002a). Financial risk or risk created through financial transactions can be associated with value reduction. This reduction is due to market factors disequilibrium such as equity prices devaluation, interest or exchange rate fluctuations. Lately, in the competitive business environment, it has been discovered that firms have to face several financial risks namely market, credit, liquidity, operational and legal risks. The uncertainty scenario undoubtedly has had an impact on the volatility level of the financial market, thus influencing the return of an investment. Reflected in various dimensions such as the stock market, exchange rate, interest rate and commodity market, a volatile environment exposes firms to greater financial risk levels. Volatility that creates new dimension of busi ness and systematic risk then forces firms to amend congruently their operational structure to accommodate changes in the environment. These conditions motivate firms to find new and better ways to manage risk, specifically in the case reported by Dowd (1999a) where investors were exposed to multiple problems of market risk. Although risk cannot be totally eliminated, Fong and Vasicek (1997) stress that its effect, particularly on investment losses, can be minimized thoroughly when one understands and manages it according to an effective risk measurement methodology. Ironically, the tremendous evolution in risk management practices coupled with innovation of financial engineering instruments have several distinctive effects, depending on the nature of business (Basle Committee, 1994; Dowd, 2005; Fong Vasicek, 1997; Gastineau, 1993; Holton, 2003; Ibrahim, 1994). As indicated by several observers such as Brooks and Persand (2002) and Rahl and Lee (2000), viewing different kinds of business and investment portfolios based on an effective risk measurement tool is crucial in order to maximize returns and minimize risk. Thus by combining fundamental and analytical techniques to create new risk evaluation approaches, the process will be in a much better form to prevent larger financial losses. JP Morgan (1996) highlighted that the absence of a common point of reference for market risks makes it difficult to compare different approaches towards the measurement of market risks. The growing need for better empirical investigations to evaluate alternative measures of risk, says Brachinger (2002), realistically depends on whether the objective is to forecast choices under uncertainty or to provide superior predictors of introspective judgements about the risks being perceived. Along with the urgent needs of financial institutions to devise suitable mechanisms of risk management, the quantification of risk may avoid inappropriate policy decisions which can affect stake holders. As noted by Nath and Reddy (2003), should the underlying risk not be properly estimated, it will lead firms to a lower profit level and jeopardize the financial stability condition, since less optimum capital is allocated throughout the organization. The theory and practice of risk management have developed extensively since the pioneering study of Markowitz (1952) who presented portfolio risk as the dispersion of standard deviation around the average return or mean. This modern investment theory, as portrayed in the well-known Portfolio Selection: Efficient Diversification of Investment, assists market users to incorporate results of wealth distribution according to an assets class and the best investment position. Following Markowitz (1952), risk of a security was later portrayed by Sharpe (1963, 1964) as its covariance with respect to the general market index or Beta. From there, the measurement and evaluation have since evolved to handle a portfolios market risk. Although the trade-off between risk and return is well recognized (higher returns can only be obtained at the expense of higher risk), JP Morgan (1996) points out that the risk measurement component of the analysis has not received broad attention. Within the same perspective, JP Morgan (1996) also reports that the exclusive attention on the role of return, however, has led to incomplete performance analysis. They conclude that the return measurement gives no indication of the cost in terms of risk. By the early 1990s, Value-at-Risk (henceforth VaR) had gained immense popularity and had become an integral risk management tool and a standard to monitor and control a firms risk exposures. By definition, VaR summarizes the worst expected loss that an institution could suffer over a target horizon under normal market conditions at a given confidence level (Butler, 1999; Dowd, 2005; Jorion, 1997, 2006). Cassidy and Gizycki (1997) conversely termed VaR as the earnings-at-risk or a pote ntial loss amount. The main reason underlying its popularity lies in its simplicity of providing a single statistical figure summary of possible potential losses within a given time horizon. Since the introduction of the simplest VaR models, a range of approaches to calculate VaR has expanded from two important perspectives; number and complexity. Without doubt it is likely that VaR will become even more widely adopted over time (considering the views of academia and practical interest), since it is thought that such an approach may signal inefficiency in capital charges. Although Dowd (1998) reports that VaR enables firms to get a better sense of the overall risk and serves as a determinant of capital adequacy, the VaR methodology is not without criticism, one of which is that VaR may underestimate risk over simplified assumptions of normally distributed returns and constant variance. This is the case when ample empirical evidence has shown that rates of return distributions of financial time series exhibit fat tails, skewed to the left or peaked around the mode (Bali Gokcan, 2003; Glasserman, Heidelberger, Shahabuddin, 2000b; Zangari, 1996) and that volatility is time-dependent or better known as volatility clustering (Mandelbrot, 1963). Triggered by these circumstances, several related non-normal issues and consequences have been identified. From a regional perspective, an earlier survey by Murphy and Quinn (1993) observed that risk management practices by most Asian companies are underutilized. Both authors reported many companies either do not have any authorized risk management department/unit/staff or they lacked of precautionary actions to face instability in the business environment. Such act will definitely increase a firms risk and should be an encouragement to market users to pay extra attention to financial risk management aspect. In particular, since the 1980s the Malaysian economy has experienced several phases of growth and recession si tuations. Until June 1997, Malaysia grew prosperously with Gross National Product increasing at an average value of eight percent each year for eight consecutive years. But it was not long after mid 1997 that South East Asian countries were hit by currency crises which were led by misallocation of funds and overinvestment of capital (Dean, 1998, 2000). With extensive capital control, inclusive of pegging the Malaysian Ringgit to the US Dollar, Malaysia witnessed a better environment compared to its neighbouring countries, starting from the year 2000. As a result of a competitive market leading to higher risk exposure, professionals have turned their attention to search for a tool to measure VaR bounds with a specific distribution assumption without simultaneously over or underestimating it. Some of the current issues in VaR measures which motivate this research are explained in the following section.

Hills Like White Elephants - 911 Words
Every day people make decisions that affect their future lives. What makes a right decision? What may be right to some may be wrong to others. Right and wrong decisions are objective and vary among each individual. ââ¬Å"Hills Like White Elephants,â⬠by Ernest Hemingway, portrays the idea of decision making between two characters in a valley in Spain as they wait for a train to arrive. Jig, the protagonist, attempts to make a crucial change in her life by making the right decision, although her flaws, including indecisiveness, prevent her from taking action in her decision. Jig and the American have had a romantic relationship for quite a while and now their future together is in jeopardy. The two of them are having a conversation on whether or not Jig should get an abortion. The man is trying to convince the woman to do something she is hesitant to do. Hemingway uses metaphors and symbolism to express their feelings and decision-making. ââ¬Å"Hills Like White Elephantsâ⬠displays the differences in how a man and a woman may view pregnancy and abortion. Usually suppliers give 30-90 days credit to the manufacturer.(Fosberg, 2013) Bank Credit- Commercial bank gives advances in the form of short term finance which is known as bank credit. When bank credit is allowed the withdrawer can withdraw the amount either in installment or at one time. Medium Term Source Of Finance The types of medium term source of finance are as follows:(AbdulsAleh, 2013) Loans: loan provided for a term of 3-7 years period is known as medium term finance. The interest on loan can be fixed or variable. Lease Financing: Bank also provide finance lease which are supported by some foreign investors when compared with traditional source of finance. Long Term Source Of Finance The types of long term source of finance are as follows: Shares: a share is a share in the share capital which includes stock. Debentures: A debenture is a document under the common seal that acknowledges loan to the company. Interest payments on debentures are tax deductible. Factoring: factoring refers to the services provided by the financial institution. Factoring is highly convenient form of finance. Rate of interest charged on factor is same as the rate charged on bank overdraft.(Caprio, 2012) All the three types of finance i.e. short term finance (for a period of maximum 3 years), medium term finance (for a period of maximum 3-7 years) and long term finance (for a period of more than 7 years) can be taken up by the business concern depending on their need and want of fund or capital. Conclusion On going over all the sources of finance available and the business forms which can be taken from the money inherited from the will and thus keeping in mind the advantages as well as the cons the decisions of the business form should be taken. If the capital is good enough to expand the business in future it can choose to go for LLP or company as well which would provide it with a good stage to grow in the long run Recommendation. The major decision is that whether the amount of loon needed can be financed from the long term or short term funds to suit the business style taken by the brothers. If they think of a limited company then there will be a need for the long term funds and of high amount also and if not small amount would also suffice. Therefore the decagons to the choose the write source rests on the company and the manager itself. References AbdulsAleh, A. M. (2013). MEDIUM TERM FINANCING. Liberilism Vs. Conservatism Essays - Presidency Of Harry S. Truman
Liberilism Vs. Conservatism When one thinks of liberals and conservatives it tends to be a comparison of entirely different views concerning every issue. Conservative thinking is regularly associated with the Republican Party while liberal thinking is regularly associated with the Democratic Party. Two such figures that come to mind whose views tend to put them on opposite sides of the political spectrum are presidents Herbert C. Hoover and Harry S. Truman. For example, Hoover's failure to intervene in the private sector of the economy during the infant stages of the Great Depression agrees with the conservative idea of a free market economy. In contrast, Truman continued Roosevelt's liberally supported reform measures. One important factor that influences a political figure's decision making is his/her morals and beliefs. Conservatives usually have great influence from traditional institutions such as church. As a child, Hoover was raised in a rural Quaker community with a strict belief in the church and the traditional family. This led to his conservative beliefs and actions. During his presidency, Hoover promised to uphold the prohibition amendment, since drinking was seen as an evil in the Quakers (Encarta). Furthermore, he promised to enforce national laws. This went about with the conservative that that authority is needed to make man resistant to evil. Hoover became a millionaire by the time he was forty with great effort. His conservatism and respect for authority earned him that position. On the other hand, liberalism preached that belief that man has a natural ability to reason out right and wrong. Truman did not introduce any major crime legislation, nor did he believe that much authority was needed for man to reason out right and wrong (Bernstein 93). Concerning the views on the nature of man, Truman and Hoover developed their views in their early years. Truman being a farmer at heart never let go the hardships of farm life. He was a self-taught man, he would read many novels, and American history books in his spare time instead of the usual childhood activities. He believed that man is basically good, and not being a wealthy man himself, he believed that wealth makes man corrupt. Hoover had a typical country childhood, and his Quaker beliefs taught him that man is basically evil (Smith 146). He believed greatly in the church to teach him what to strive for in life and what is right and wrong. These childhoods influenced Hoover and Truman in their conservative and liberal beliefs. Liberals encourage social change such as civil rights. Truman was a great advocate of civil rights. Truman, as a senator, signed an unsuccessful petition to end a filibuster on an anti-poll tax measure, and agreed to investigations of racial discrimination on war contracts and in the armed services (Encarta). Civil rights leaders saw Truman's Fair Deal legislation useful to African-Americans, it included a full employment act, increased unemployment compensation, and a higher minimum wage. In 1948, Truman asked Congress to enact laws prohibiting Jim Crow laws, and he instructed the Secretary of Defense to end discrimination in the armed services. These and many other measures Truman took to enforce his belief in a rapid social change. Walter White said in 1952 ?No occupant of the White House since the nation was born has taken so frontal or constant a stand against racial discrimination as has Harry S. Truman.? His legacy paved way for the civil rights movements in later years. Hoove r, being a conservative, believed in slow very moderate social change built around past traditional values and beliefs. Hoover did not ask congress to pass any new laws, nor did he take any measures concerning social change in the form of welfare and civil rights (Smith). His beliefs stood in the way of making any social change for the betterment of society. Liberalism in the 20th century has been very active against inequality. The Truman administration started the battle continuing to later generations. Truman, being a southern man, saw the racial discrimination in the South and saw a need for social change. Truman felt that African-Americans wanted to end inequality, but not segregation. As stated above, Truman took many measures to ensure equality for the African-Americans. He also took measures to create

Kino and Juana's reaction after finding the pearl Essay
Kino and Juana's reaction after finding the pearl - Essay Example Waste treatment is hazardous should also get opposed in the neighborhood. The deep injector, as well as the waste incinerator, possess threats to humanity, therefore, should be opposed from being constructed in the society (Barrow 34). There should be set up strategies to regulate the solid waste. One of the strategies is the location restriction. The strategy should ensure that the landfills get constructed in the most suitable areas. Another strategy is the operating practices. It incorporates the covering as well as compacting waste with soil to eliminate odor. There should also be the monitoring requirements on the ground water. The water should be tested constantly to ensure there is no escape of the waste materials from the landfills (Barrow 44). Among the strategies that should be used is the creation of public awareness on the waste strategies. Infrastructure should also be improved to hold hazardous waste. There should also be the establishment of the council to assess and also regulate toxic substances. The state should also take a major role towards the prevention of waste and use of toxic products by consumers. Water is a basic necessity of a man alongside being an economic good. Raising its cost means that people who earn low income will not manage to handle it and, therefore, raising the price of water should get opposed. Government subsidies that enhance farmers to access water at affordable prices should not get withdrawn since it will affect both the lives of farmers together with the economy of the state. Provision of government subsidies that will enhance efficiency in irrigation should be encouraged since it will improve peopleââ¬â¢s life as well as enhancing economic growth (Barrow 54). There are various human activities that accelerate flooding. Blasting is one of the human activities that cause flooding. It results to landslides in hill and mountain slopes that may result in damming of streams and rivers. There should

Barney's Entanglements with Various Aspects of Property Law Essay
Barney's Entanglements with Various Aspects of Property Law - Essay Example First his son Opie had used the property as collateral for a loan, and with a payment default the property was being pursued for foreclosure by the lending party. Next Barney finds out that Ernest had been squatting on that property for about two decades, and claimed ownership for that reason. First Barneyââ¬â¢s ownership claim on the property is legitimate, under the principle of law called ââ¬Å"joint tenancy with right of survivorshipâ⬠. The caseââ¬â¢s citing this principle is valid, and that Barney had legal right to the mountain property as alleged. The interesting aspect of this principle of law is that when a partner co-owner dies, the lawââ¬â¢s operation automatically grants full rights of ownership to the remaining co-owner, with no regard to the power of a will to subvert that operation (Farlex, 2012; James T. Blazek & Associates, 2000). Opie was able to use the land, meanwhile, as collateral on the strength of his stake on this property, from a will by Barne y. There is some legal opening for Barney to explore this aspect of joint tenancy law in order to contest the legality of Opieââ¬â¢s use of the land as collateral for the failed loan. Meanwhile, Barneyââ¬â¢s larger problem seems to be that Ernest had usurped the land, and may have legal ground to stake the claim to that land and retain ownership. As the case states, Ernestââ¬â¢s possession of the land is uninterrupted for two decades, is notorious, and for that long period of time uncontested. Under adverse possession law, where usual limitation statutes for contesting ownership is seven or twenty years, Ernest may have a case for claiming legal ownership of the land (Cornell University Law School, 2010). As a lawyer my advice would be for Barney to weigh how much the property means to him versus how much his relationship with Opie means. He can pursue a case contesting the legality of the use of the land as collateral, but there is the matter of Ernest having probable vali d claim to the land that complicates things. Barney here is stuck between a rock and a hard place. On the one end he is being pursued by the lender who wants to foreclose. On the other Ernest had laid claim to the land. There seems to be no easy way out of this. The mountain property maybe a lost cause (Cornell University Law School, 2010; Farlex, 2012; James T. Blazek & Associates, 2000). II. The Beach Property The town authorities cited eminent domain as the primary law principle that justified their appropriating Barneyââ¬â¢s property for use to develop the beach front into the Nickelodeon facility that Barney thought so little off. Now eminent domain is a power of the state and of the governments, in this case of the county government, to do such appropriating of private property for particular purposes, but it is not clear in the case that the town itself was the acting developer, or whether the town was citing eminent domain in order to profit a private developer who may be the real owner of the resort. There is the element of eminent domain that the land appropriated must be for the use of the public. In this case, while the resort is supposed to be for the general public, it might be a privately owned enterprise, in which case the use of eminent domain may not be applicable, or valid. There is a case to be made for contesting the right of the town to take away Barneyââ¬â¢s beach property, on the basis of the use of eminent domain as the primary excuse is an invalid interpretation of the eminent domain doctrine. In fact, the literature lists exactly

A Technical Analysis of Ergonomics and Human Factors in Modern Flight D
I. Introduction Since the dawn of the aviation era, cockpit design has become increasingly complicated owing to the advent of new technologies enabling aircraft to fly farther and faster more efficiently than ever before. With greater workloads imposed on pilots as fleets modernize, the reality of he or she exceeding the workload limit has become manifest. Because of the unpredictable nature of man, this problem is impossible to eliminate completely. However, the instances of occurrence can be drastically reduced by examining the nature of man, how he operates in the cockpit, and what must be done by engineers to design a system in which man and machine are ideally interfaced. The latter point involves an in-depth analysis of system design with an emphasis on human factors, biomechanics, cockpit controls, and display systems. By analyzing these components of cockpit design, and determining which variables of each will yield the lowest errors, a system can be designed in which the Liveware-Hardware interface can promote safety and reduce mishap frequency. II. The History Of Human Factors in Cockpit Design The history of cockpit design can be traced as far back as the first balloon flights, where a barometer was used to measure altitude. The Wright brothers incorporated a string attached to the aircraft to indicate slips and skids (Hawkins, 241). However, the first real efforts towards human factors implementation in cockpit design began in the early 1930's. During this time, the United States Postal Service began flying aircraft in all-weather missions (Kane, 4:9). The greater reliance on instrumentation raised the question of where to put each display and control. However, not much attention was being focused on this area as engineers cared more about getting the instrument in the cockpit, than about how it would interface with the pilot (Sanders & McCormick, 739). In the mid- to late 1930's, the development of the first gyroscopic instruments forced engineers to make their first major human factors-related decision. Rudimentary situation indicators raised concern about whether the displays should reflect the view as seen from inside the cockpit, having the horizon move behind a fixed miniature airplane, or as it would be seen from outside the aircraft. Until the end of World War I, aircraft were manufactured .. ...anifest. The discussion of biomechanics in chapter three was purposely broad, because it is such a wide and diverse field. The concepts touched upon indicate the areas of concern that a designer must address before creating a cockpit that is ergonomically friendly in the physical sense. Controls and displays hold a little more relevance, because they are the fundamental control and feedback devices involved in controlling the aircraft. These were discussed in greater detail because many of those concepts never reach the conscious mind of the operator. Although awareness of these factors is not critical to safe aircraft operation, they do play a vital role in the subconscious mind of the pilot during critical operational phases under high stress. Because of the unpredictable nature of man, it would be foolish to assume a zero tolerance environment to potential errors like these, but further investigation into the design process, biomechanics, control and display devices may yield greater insight as far as causal factors is concerned. Armed with this knowledge, engineers can set out to build aircraft not only to transport people and material, but also to save lives.

Analyse How Businesses Are Organised Essay
Definition: The way a business is organized internally to enable employees to carry out their job roles and communicate with each other. There are many Organisational structures these organizational structures allow you to know what everyoneââ¬â¢s role is in a business and also who they have power over. The business is able to work more sufficiently if they have an organizational chart. Span of control ââ¬â A span of control is the number of people who report to one manager in a hierarchy. The more people under the control of one manager, the wider the span of control. Less means a narrower span of control. Chain of command ââ¬â Chain of command is the order in which orders and decisions are passed down from top to bottom of the hierarchy. Line Manager ââ¬â A Manager who is responsible for achieving an organisations main objective by executing functions such as policy making, target setting and decision making. Purpose of organisational chart: The purpose of an organizational chart is that it depicts the staffing order of a company. It is commonly shown in a hierarchical format; it also helps identify who does what in an organization, how many staff work in the company and what the chain of command is. This information is important to internal staff, HR departments, stakeholders and board members. Why is there a need for an organizational STRUCTURE? It is essential for a business to have an organizational structure because if they didnââ¬â¢t have one the business would be a disorganised mess. Here are the advantages of having an organisational structure. Firstly it would be favorable towards the employees. There would be less inconvenience as the employees who- know who to go to and report to if they have any problems and need a person higher up in the hierarchal structure of the business to sort it out for them. Therefore the workers would know what responsibilities they have and what job they would need to do. Without the structure a business has the employees wouldnââ¬â¢t be able to carry out their jobs and the departments of the business would have too many employees or too little. Moreover both business London Heathrow Marriott and McDonald are allocated nationwide which shows that they need to be able to carry out orders quick and adequately which it also shows they are well organized. London Heathrow Marriotts organ isational structure: Here is London Heathrow Marriottââ¬â¢s organizational chart. London Heathrow Marriottââ¬â¢s hierarchical structure is a Flat centralized hierarchy structure this allows the business to make faster decisions and it allows more responsibilities for the managers and others increasing motivation but this disallow to fewer opportunities for promotion leading to lower self-confidence. the advantages of a flat hierarchical structure for lhm: A wide span of control is an example of an organizational structure and where additional employees are at an equal level instead of being superior to one another. This is an advantage to the London Heathrow Marriott as it tells us that there are fewer hierarchies consequential in an easier and faster communication. Also there would be fewer employees working at the top of the hierarchical structure which means it would cost the hotel less money. This shows that employees lower in position are not constantly maintaining authority and being managed which will make the workers more persistent and give incentive to achieve their responsibilities to the best of their abilities. This will give confidence to the employees to work to the best of their abilities and show that they are committed to their job which could lead to receiving a promotion which shows that London Heathrow Marriott donââ¬â¢t have to spend more money in order to train new employees. This also shows that London Heathrow Marriott are not losing any sufficient amount of money which they can spend on something else and it also shows that they are achieving their aim of making ââ¬Ëà £20million per annumââ¬â¢ of profit. In addition to being able to communicate without any trouble there is also ââ¬Å"excellent team spiritâ⬠. Disadvantages of a hierarchical structure for lhm: Even though there are lots of advantages to having a flat hierarchical structure it has its disadvantages. When some employees have other bossââ¬â¢s it shows that it is a flat hierarch in a business. This is sometimes not meant or adapted for a particular purpose and can cause lot of Trouble or difficulty caused to oneââ¬â¢s personal requirements or comfort, they may find it distressing being controlled from more than one bossââ¬â¢s. Also there is less control within the business as there is only one manager per department and it would be harder for the manager to keep track of each inferior to who they are in charge over. This shows that there is a large area of responsibility this might direct to some tasks that a business wants to achieve to be completely inefficiently meaning that they want to do things without any trouble which can effect the business as a loss for the business as there might be a problem but if it hasnââ¬â¢t been fixed or repaired after a period of time and if the person in charge of the people lower in the chain e.g. trainees, employees might be dealing with a lot of staff but some jobs and prospects of a business might be at risk of no longer existing. Therefore there will a less chance of getting promotions as a flat hierarchical structure as described in the hierarchical chart, there are more people lower in the chain than there is of superiors leading to lower morale. how flat hierarchical structure helps LHm achieve its aims and objectives: One of the objectives London Heathrow Marriott wish to achieve is; ââ¬Å"75% of guestââ¬â¢s to be satisfiedâ⬠. The hierarchical organizational structures lead staff a clear principle to what their job is and the aims and objectives they should meet. With a flat hierarchical structure there is less confusion for employees and also many customers are satisfied, especially when the employees in the business know what they are doing. London Heathrow Marriott also want to achieve;ââ¬Å"Labour turnover less than or equal to 25%â⬠.By having a flat hierarchical structure in the business shows that rules within the business are made faster, furthermore managers are able to take actions quicker to any worries which a employee has. Hence employees will feel as if their need and concerns are heard out and met so they wouldnââ¬â¢t have any reason to leave the business. McDonalds organisational structure: Here is McDonaldââ¬â¢s organizational chart. McDonaldââ¬â¢s hierarchical structure is a flat plan. Where there is one manager who is in control of the other assistants and employees. He takes all the decisions and he is in charge of the main functions. This makes it very simple for the staff because all they have to do is selling. This way they can pay more attention to the customers, so I think this is indeed the best structure for a McDonaldââ¬â¢s restaurant. But the McDonaldââ¬â¢s corporation has a hierarchical structure. This is a huge company with lots of different departments which has to be organized very well, because if the employees arenââ¬â¢t directed in the right way they wonââ¬â¢t do their jobs right. So this way it is all ordered and the people can work undisturbed, this saves time and money for the business. the advantages of a flat hierarchical structure for McDonaldââ¬â¢s: The advantages of a flat hierarchical structure for McDonald are that faster decision can be made so that they wouldnââ¬â¢t have to waste time on making decision and make quick profit. Also there is a shorter channel of communication so that employees can find out any necessary information which they need to know. It is also more cost effective as Flat Organisation is less costly because it has only few managers. It also creates fewer levels of management. It is more suitable for routine and standardized activities. Disadvantages of a hierarchical structure for McDonaldââ¬â¢s: There are chances of losing control because there are many subordinates under one manager this will result in bad discipline in the organisation as they have lost control. ââ¬âââ¬âââ¬âââ¬âââ¬âââ¬âââ¬âââ¬âââ¬âââ¬âââ¬âââ¬âââ¬âââ¬âââ¬â [ 1 ]. The abortion pill is often called medication abortion, but its scientific name is mifepristone. The first step for this is to have a physical examination by a doctor, and then the health care provider can give the pill that works by stopping the hormone progesterone, which causes the lining of the uterus to break down. A long with the abortion pill itself, antibiotics are received from the health care provider. A second medication, misoprostol, is taken 24 to 48 hours after the abortion pill to empty the uterus. Two weeks later, a follow up examination will take place to confirm that the abortion was successful and that the woman is healthy (Planned Parenthood). Aspiration, or vacuum aspiration, is another form of abortion, and it takes place in a clinic.
